Pre-Employment Inquiries and Medical Questions & Examinations
The ADA places restrictions on employers when it comes to asking job applicants to answer medical questions, take a medical exam, or identify a disability. An employer may not ask a job applicant, for example, if he or she has a disability (or about the nature of an obvious disability). An employer also may not ask a job applicant to answer medical questions or take a medical exam before making a job offer. An employer may ask a job applicant whether they can perform the job and how they would perform the job. The law allows an employer to condition a job offer on the applicant answering certain medical questions or successfully passing a medical exam, but only if all new employees in the same job have to answer the questions or take the exam. Once a person is hired and has started work, an employer generally can only ask medical questions or require a medical exam if the employer needs medical documentation to support an employee’s request for an accommodation or if the employer has reason to believe an employee would not be able to perform a job successfully or safely because of a medical condition. The law also requires that the employers keep all medical records and information confidential and in separate medical files.

I don't believe that every employee knows what they're rights are, what they don't have to put up with, and that they shouldn't be intimidated by any means for asking for help or reporting misconduct regardless of the matter. I've seen too many coworkers let things slide because they're scared of losing their job. It really makes you wonder what really goes on at work that no one wants to talk about, all because it pays the bills.
I've recently have faced some issues at my previous place of employment. During the last 6 months there, I had a few people back me up and believe that the :problem" would be fixed. Well it was, just not the way i expected it too. Needless to say they overlooked my previous complaints and my please for help, the manager of the business ignored me, and they allowed an employee get away with way too much and do what he wants and I'm the one that ended up unemployed!
Sorry. I added a little more than I wanted and got away from my point. Anyway, I know how horrible it feels to feel like you're fighting an army all by yourself! I tried to find help outside of work and nothing. Nothjng more than counseling, attorneys if you can afford them and if you actually have a case, and of course BOLI; again, that's only for discrimination issues. There is nothing that I've seen that helps to resolve workplace issues by a company or group that is biased. I'd like to have an advocacy group for employees and employees only. I want to advocate for the little guy, for the one that is too scared to stand up for him/herself in fear of termination and no one should be in fear when they talk to HR, a supervisor, or anyone that hold authority.
Your thoughts? Ideas? Information that I didn't find?

I just got fired today from a wing of DOD MWR after working there for 18 months, I was told I was fired because I was disrupted with other employees, I have never received a write up or anything that would make me believe I was in any way in jeopardy of loosing my job. I believe I fired because my supervisor was intimidated by me being a male and I feel this is a form of discrimination, what can I do? This is so strange

Jobs are available for Internal candidates bylaw as soon as the job is available: .
- The company would not put me a through compensating airfare, hotel other expenses to fly me to a panel interview if there was an internal candidate.
- I went through a lengthy process of a 90 day assessment and other means of getting to a two phase group interview.
- If the company had an internal candidate available then I doubt the above would occur or would have stopped the process..
- I learned the vacancy was not filled and others vacancies are open.
- I lost a job during the whole process, and yes; in this circumstance, I deserve an answer.
In summary, I highly disagree and do get a sense that the majority disagreed with my candidacy for this role. I feel that if doubts were raised in other screening situations then I should not have traveled and wasted so much time. I do appreciate your feedback, but companies waste time or even hire the wrong people and can become complacent. Finally, I do not judge others by color appearance or if he or she is highly educated. I merely, stated this can be possible if one is intimidated if the candidate may have more knowledge or the candidate may appear more attractive. This happens for in the real world and possibly in my case. Unfortunately. this was my best guess as to why perhaps I did not get the job after analyzing the final phase or I may have been over qualified. I do not know. I would hope companies would select interviewers who are non biased. Unfortunately, this even happens in a courtroom. Judges are trained to become non-biased. However, judges are too.

I got fired.my employer abused me for the last 3-4 yrs. I was physically and mentally abused.my area manager bumps in to me on purpose more than 3x. My supervisor lies about me.HR told me "I CANT EVEN HEAR YOUR ACCENT". They paid me less than the job was intelled and told me if you don't like it there's the door.

Did you know that discrimination or slandering an ethnic group is not against the law in the state of WA. I know simply because I experienced something similar and most of attorneys I have talked to stated the same. Sad.

First, allow me to give you a little background history. My name is Katrina Smith and, I am currently in college working towards my major. And before getting accepted into college, I have been busting my butt, in trying to find a job. I had a few jobs through a disability school work program, when I was in high school. And that has been some years now. Once, I have graduated from the program, I immediately started looking for a job. But, have gotten turn away from a few. Therefore, this leads me to my question... I have heard you shouldn't contact a job, let the job contact you. When it comes to you apply for a job, are you supposed to call that business back, or do you let them call you? I have been waiting on the two week period, before contacting that business. So, can you tell me which one is right. Thank you so much for your feedback. #jobsearch #stress #Merchandiser #disabled #discrimination

Well ,im concern about this issue because it happened to me few times already. It's sad that here in my country I experienced and had to do with it.For example ,some of the people that works in companies don't like to work with people like me.Also about making the transition on apply to desability is not easy. I try and give up.
