I was employed at Applebees for over two years and was never told by the GM nor any of the managers I was fired. I was told that I would be informed after a meeting and was never informed even though I asked over and over about my job. I have text messeges that will confirm what I am saying and how I was wrongfully terminated. Can someone help me out here please

I put in a written 2 week notice on a monday. That following Wednesday my supervisor came in to my office and informed me that that same day would be my last day and I didn’t need to fufill my 2 weeks. (Side note- My supervisor never mentioned the word “termination” or stated anything about my performance, or gave me anything in writing,) I emailed my HR department to confirm I would be getting paid for my full 2 week notice since I wasn’t given the chance to work through it. They told me they found “misconduct” on my part but refused to go into any further detail, therefore they would not be paying me through my 2 weeks. I am also due a bonus that I personally earned for the months of July, Aug and September while I was a full time employee. HR will not return any of my phone calls or emails when I ask the status of the bonus. Yesterday, I received a letter stating my benefits would be stopped due to me being “terminated.” I want to mention a few things:

  1. Every single employee that has ever been “terminated” through this company has received a 2 week severance pay - it’s a policy.
  2. Every single employee that I have personally spoken with that gave this company written notice was immediately told to leave and not offered any pay.
  3. In order to be terminated through this company, you must have 3 write ups according to their policy.

Do I have a legal leg to stand on? What can I do to get paid? At this point it’s not about the money - it’s the principal. I worked my butt off for this company and feel like I was just kicked to the curb and they could care less.

I just signed a petition supporting Sen. Warren's bill to end the so-called "right to work" state corporate power grabs:

https://act.credoaction.com/sign/warren_right_to_work?sp_ref=345641513.4.183502.e.587350.2&referring_akid=25672.7456173.X1iDuf&source=mailto_sp

I've read so many cases of unjust termination. I'm not sure how effective this petition will be, but it gets the word out to folks. Thank you!

I was terminated from a job that does not have a attendance policy. I have been with this company four years it is a part time job and and I was wrongful terminated for have to many absents. So I ask my former manager what is exceed absentees and where in the handbook do we have a policy of that natural. He said that we had one and that he would show me I was out three times after that for son being sick because I am a single mother. Need to remind you have four children and I had all of these children before this manager got in this position. Well me and this manager have had a hr issue just because of the handles and does things. And I just recently got fired September 2017 and I don't qualify for unemployment. I feel like it was personal because since that issue he has been trying to get me out the door.

If the company fired you without a warning either verbal, preferably a written warning then it was definitely a wrongful termination. Without prior warnings or disciplinary written report, then you could take them to task. However remember NJ and NY are "At Will" states, meaning employers have the right to fire or layoff their employees without prior notice whenever they deem it necessary.

I was terminated because I had a scheduled surgery, and my employer did not want to accommodate me recovery time off, post surgery. I live in NJ, and I'm not sure of the state laws when employed in a small company. I was employed there for 25 years. I believe the reason I was let go was, because the office was very much under staffed , and the owner of the company would have had to come up from FL and work my position, and that just wasn't something he didn't want to do. By the way, I found another job 2 days after my termination, and I had my surgery shortly after being hired at the new company. I went in the hospital on a Mon. and out on Wed, and back to work on Thurs. So, my termination was totally wrong. This is what one gets after 25 years of dedicated service, #crappedon
