Do you think if a person is currently in a management position the company should work with their employee if they decide to go back to school? I recently got fired due to the fact that my employer and many others thought I was on drugs however not once did they come up to me and ask me to do a drug test. They just said, we worry for you and we assume you’re on some sort of drugs so they immediately fired me after my shift. Even though everyone in the shop has/ carries a wax pen, I would get offered but would always turn it down cause I prefer not to smoke during working hours. I understand Arizona is an at will firing state but I have never had this happened. #termination #unemployment

At will firing means that they can fire you without giving you a reason. If they do give you a reason, however, it has to be a legal one. So the question then becomes, can they fire you because they suspect you're on drugs, even without any confirmation. That's what you need to look into, since they did give you a reason for termination. If they inaccurately assumed/accused you of being on drugs and that was the reason for your termination, that may not be legal depending on your state.

I had an experience while working as a Math and English tutor for HeyTutor, which partnered with LAUSD School district. I was assigned to tutor a female nonverbal kindergarten student with autism spectrum disorder. The classroom teacher instructed me to physically push the child if she bit me. I was extremely uncomfortable with this and felt that the child wasn't receiving appropriate specialized education.

I requested a reassignment to another school, citing the inappropriateness of the assignment given my lack of training and credentials, as well as the excessive distance to the school. My manager claimed she spoke to the child's teacher, but used the wrong gender for the child, indicating the conversation never happened. Instead of helping me with the reassignment, I was asked to return to the distant school to discuss it further, despite explicitly stating that I would not be able to return.

The next morning, I was terminated for insubordination, attendance issues, being clocked in without working, and at the school's request – all of which were false accusations. I have never received any negative feedback from school staff. Now, I'm finding it difficult to get work within the district due to this blacklisting. Last year a friend of mine was fired from their job after only one month due to tardiness as a result of a water leak in their apartment. They emailed their boss explaining the situation, and proceeded to deal with the plumber, landlord, and the leak itself. They had to make phone calls, bail water, and mop up all morning. After an hour they received a termination email!

At first, they were very interested in pursuing legal action. However, they reviewed their employment contract and became disheartened. It indicated that they were hired "at-will," and further stipulated that they could be fired at any point, for any reason. Ultimately, my friend just let it go, and proceeded to seek work elsewhere.

There's a lot of useful information online, mostly from law firms, employee advocacy groups, and other outlets. However, I'm curious about true stories from real employees who have pursued legal action after potentially wrongful termination.

So, fellow Jobcasers, have you ever pursued legal action after wrongful termination?

Yes I was. I worked for a company where I was faster than this particular male. He was always complaining about one thing or another. To make a long story short, I was terminated for "joking" about leaving after he whined to the owners about me (they are brothers. Anyway, I went to the EEOC to report being forced to use a back restroom (the men's room) when there was a lady's room in the hallway toward the front. I was told after a brief (and I do mean brief) investigation that there was no case because the restroom I was told to use was not specifically labeled men. Now mind you there were two Caucasian women (obviously I'm African American) who used the lady's room at will. I took as racist, but I guess they saw it differently. Here's the punch line: I was screamed on for using the lady's room and was told not to do it anymore. Obviously, somebody snitched.

Yes, I’ve pursued legal action plenty of times, but my most recent I just settled was a class action lawsuit I represented involving wage claims. This claim was originally about my former employer not wanting to verify my employment that’s required by DOT regulations. But they ended up settling for $200k for not giving us lunch breaks even though we signed a waiver for that.

The same way employees are encouraged to give 2 weeks notice, should employers also have this same time frame when intending to layoff or let go of employees? Why or why not?

“At will” employment is unfair. It is this lack of Justice which has the entire country untrusting of each other. I get up in the morning and go happily to work, only to hear, without ANY warning that I have been “let go”! Where is the trust? Employees hate their employers for these unspoken reasons. They feel cornered, disrespected (an over used word) and unsafe in the workplace. Employers develop “ plantation syndrome” where because of “at will” policies, they look at employees as being expendable and unimportant. This lack of “worthiness” makes that employee to all kinds of abuse-sexual, emotional and financial. “ I will pay YOU, Ms/Mr College degree, just a bit over broke so you can continue to do my work until I trade you in for a newer model” No amount of so called “ family” feeling or pizza is going to stop employees from being wary, always looking over their shoulders, focusing subliminally on how to CYA instead of the actual work. So toadying up to the boss, pointing out colleagues weaknesses is all a part of this dog eat dog world. A properly run business should have a clear system of reward and punishment, warnings and final notice. Also employers who feel it would be dangerous to keep an employee in the office should have a clear policy about termination pay. Or resignation pay. When I worked in a civilized, 20th century country, if I gave one month’s notice but they wanted me out, they would pay one month’s salary. Plus of course any other accrued payments. But in this 17th century plantation, you are out the door with not even a thank you!

I was terminated from my position at a call center for performance.Now here’s the funny part. I was working for the company 9 months the day they let me go, but i was told that my call were being reviewed for the last 8 months.I was told my number wasn’t good enough so i never earn a bonus. so the funny part is my first month working i did earn a bonus but i was told that i was on probation and i wasn’t entitled to it.I earned my second bonus my 4th month with the company. I was never coached about my performance and if you keep track 3 months probation plus 6 months equal 9 months so what 8 months was i reviewed for when technically they only have 5 months of calls to review #termination

This meme made me chuckle because my current employer’s application took me two hours to complete. I literally had to make a day out of it so I could concentrate solely on the application. It was definitely worth it at the end of the day.
